Terms governing UpscaleLume's free image tools, AI image tools, accounts, and one-time credit purchases.

Part A — General Terms Applicable to All Services

1. Overview

These Terms of Service (these “Terms”) govern your access to and use of the UpscaleLume website and services. By accessing or using UpscaleLume, you agree to be bound by these Terms. If you do not agree, do not access or use the Services.

2. Scope and Acceptance

Please read this document carefully. It is a legally binding contract between you and UpscaleLume. These terms and conditions of use (the “Terms and Conditions,” “Terms of Use,” or “T&Cs”) govern the terms, access rules, and use of the UpscaleLume services (the “Services”), which form an integral part of these T&Cs.

By using the Services: (i) you become a user of the Services (a “Client,” “User,” or “you”); (ii) you unconditionally accept these Terms and Conditions in full; and (iii) you confirm that you have read and understood the UpscaleLume Privacy Policy. Use of the Services requires your complete and unreserved acceptance of these Terms of Use.You represent that you have read, understood, and fully accepted these Terms of Use. If you do not agree to these Terms and Conditions, or are unable to comply fully with them, do not access or use the Services.

By accepting these Terms and Conditions, you agree that you will:

  • read and understand all terms set out in these Terms and Conditions;
  • assume all legal obligations arising under these Terms and Conditions;
  • use the Services only as permitted by law and without violating or infringing the lawful rights of any third party;
  • not share a registered account with any other person, including another registered user;
  • not use the Services to engage in unlawful conduct or conduct that violates applicable laws or regulations, including by breaching these Terms, creating unlawful content or spam, or providing instructions for unlawful conduct; and
  • not collect, process, or store personal data about other users or third parties without complying with applicable data protection laws.

UpscaleLume may revise these Terms and Conditions from time to time in response to regulatory developments, service improvements, or other reasonable needs. Section 18 governs such revisions. You are responsible for reviewing the current Terms and Conditions periodically. If you continue to use the Services after a revision takes effect, you will be deemed to have accepted the revised Terms. If you do not agree, you must stop using the Services.

You may purchase and use UpscaleLume Services only if: (a) you are at least 18 years old; and (b) no judicial or administrative authority has prohibited you from using such services in your jurisdiction, place of residence, or place of access.

The Services are not directed to persons under 18 years of age. If you are under 18, do not purchase, access, or use the Services.

Your use of the Services also constitutes acceptance of notices, usage rules, operating instructions, and warnings that we provide to you after you accept these Terms and Conditions.

If there is any conflict, inconsistency, or contradiction between the general terms in Part A and the Specific Terms for particular services in Part B, the Specific Terms applicable to the relevant service will prevail.

If you breach these Terms and Conditions, UpscaleLume may close your account or terminate your access to the Services.

3. Privacy Policy

Our processing of personal data in connection with your use of the Services is described in our Privacy Policy, which forms an important part of these Terms. Please read it before using the Services.

4. Limited License

Subject to your continued compliance with these Terms, UpscaleLume grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Services during the term of these Terms for lawful personal or commercial purposes. This license does not convey ownership of the Services or grant any right not expressly granted in these Terms.

Any use of the Services other than the use expressly authorized by UpscaleLume under these Terms requires our prior express written authorization. You may not copy, modify, adapt, distribute, or publicly communicate the Services beyond the scope of the authorization granted by these Terms. In particular, without UpscaleLume’s prior authorization, you may not copy the Services, modify source code, create derivative works from the Services, make the Services publicly available, or distribute them.

If you breach these obligations, UpscaleLume may, in its discretion, take measures permitted by applicable law, suspend the Services, and/or terminate your access to the Services.

5. Rules for Using the Services

You must use the Services only for their intended purpose and in accordance with applicable law, these Terms, public order, and principles of good faith, while respecting the rights of UpscaleLume, other users, and third parties. We may establish reasonable technical and usage limits to protect service security and stability, fairly allocate resources, or comply with law.

The following are not reasonable or compliant uses and are expressly prohibited:

  • automated or manual scraping, crawling, scanning, bulk extraction, or similar activity directed at the website, Services, or their interfaces;
  • submitting tasks, invoking features, or consuming system resources through automation, at an abnormal frequency, or otherwise beyond normal human use;
  • sharing an account, providing account credentials to a third party, or using an account that does not belong to you to access the Services;
  • circumventing, bypassing, or interfering with file or image size limits, task limits, request-rate limits, concurrent-processing limits, download periods, or other usage restrictions; or
  • otherwise abusing the Services beyond what is reasonably necessary for lawful personal or commercial purposes. We may review unusually high task volumes, request volumes, or account activity and take appropriate action.

Use of the website and AI Image Tools requires an internet connection. Your internet service provider may charge separate fees, and you are responsible for your connection’s availability, speed, and cost.

UpscaleLume is not a long-term image archive or backup service. You are responsible for retaining files that you need to keep and for downloading processing results within the download period shown on the relevant page. We may change available features, file formats, file sizes, pixels, processing capacity, or other reasonable limitations at any time.

6. No Modification, Reverse Engineering, or Model Training

Certain elements of the Services are confidential information of UpscaleLume or its licensors. Except as expressly permitted by these Terms or required by applicable law, you must not, and must not permit any third party to:

  • modify, port, adapt, or translate any part of the Services;
  • reverse engineer, decompile, disassemble, or attempt to discover source code, data representations, underlying algorithms, models, methods, processes, or other technical components of the Services;
  • reconstruct, imitate, or substitute the Services by monitoring, tracking, or aggregating system inputs, outputs, or behavior; or
  • use service-operation data, interface behavior, non-user-owned service content, or information obtained by observing or aggregating service inputs and outputs to create, train, test, or improve any artificial intelligence or machine-learning system, model, or algorithm.

If applicable law permits you to decompile the Services to obtain information necessary to achieve interoperability with other software, you must first request that information from UpscaleLume. We may, in our discretion, provide the information or, to the extent permitted by law, impose necessary and reasonable conditions on any decompilation activity to protect our intellectual property and other rights.

7. User Accounts

You may create an UpscaleLume user account (an “UpscaleLume User Account”) through registration options made available in the Services. After registering through any service entry point, you may use that account to access other Services that we make available to that account. Different Services, features, offers, or trial eligibility may have their own sign-in, verification, usage-limit, or eligibility requirements. We may require email verification or other reasonable account verification based on risk, service functionality, or legal requirements.

Larger-volume credit packs are one-time credit packages with higher credit amounts and longer validity periods. They distinguish package specifications such as the number of credits, price, or validity period, and do not constitute a multi-user account or an organizational service. Unless a service page expressly states otherwise, purchasing such a package does not create subaccounts, member seats, member invitations, role management, a shared workspace, or any other multi-user account benefit.

You must provide true, accurate, and complete information and update it when it changes. You are responsible for safeguarding your email address, sign-in methods, passwords, sessions, and other account credentials, and for activity occurring through your account. You may not sell, rent, share, transfer, or permit another person to use your account or account credentials as if they were you.

If you discover or reasonably suspect unauthorized use of your account, you must promptly take reasonable steps using the account-security features then available through the Services, such as changing your password, re-verifying a sign-in method, or ending active sessions. To protect account security, we may require reasonable identity verification before restoring access, disclosing account information, processing a refund, deleting an account, or changing material account information. UpscaleLume is not liable for loss or damage caused by the compromise of your account credentials or your failure to follow security notices or warnings sent to your email address or another available contact channel.

You may stop using the Services and request deletion of your account at any time. Account deletion does not automatically create a right to a refund and does not affect records that we must retain for payment, financial or tax purposes, fraud prevention, security, dispute handling, or legal compliance.

8. User Conduct

You must not use the Services for any unlawful, prohibited, rights-infringing, or potentially harmful purpose. Content that you input, upload, generate, create, publish, or distribute must comply with applicable law and must not infringe the lawful rights of any third party. You are responsible for reviewing, verifying, and assuming responsibility for content or processing results before using, publishing, distributing, delivering, relying on, or otherwise acting on them. You must not damage, disable, interfere with, overload, or degrade the Services, or cause unauthorized harm or alteration to the Services, other users, or third parties. In addition to other prohibitions in these Terms, you must not:

  • without written permission, copy or extract service data, information, or content made available by UpscaleLume or not owned by you for data mining, dataset creation, model training, or similar purposes;
  • circumvent, disable, or interfere with security features of the Services, or impose an unreasonable load on the Services;
  • access, attempt to access, or interfere with another user’s account, content, or data;
  • deceive, defraud, impersonate another person, steal, or attempt to obtain another person’s account, password, or other sensitive information;
  • misuse support channels or knowingly submit false information about another user’s alleged violation;
  • coerce, threaten, harass, abuse, or harm another person, including another user or our personnel;
  • upload, transmit, or attempt to transmit viruses, worms, trojans, or other malicious code;
  • infringe the intellectual-property rights of a third party or UpscaleLume, including rights relating to programs, databases, software (source code and object code), interfaces, or trademarks, whether registered or unregistered; or
  • use the Services to generate, create, or disseminate synthetic media, deepfakes, or AI-generated content for the purpose of deceiving, defrauding, or misleading a third party.

9. User Content

In these Terms, “User Content” means any text, information, communication, or material that you upload, import, incorporate, or generate through the Services, including audio files, video files, electronic documents, images, and materials in any other form.

You retain ownership of the images you upload. UpscaleLume does not acquire ownership of User Content merely by receiving, storing, transmitting, or processing it. Unless you separately give express authorization, UpscaleLume will not itself use input or output images submitted to the AI Image Tools to train, fine-tune, or improve an artificial-intelligence model, and will not instruct a third-party AI service provider to use them for those purposes. Processing undertaken by third-party AI service providers to provide the Services, maintain security, troubleshoot faults, or meet legal obligations is governed by their terms, privacy policies, the relevant disclosures in Part B of these Terms, and the Privacy Policy.

To complete an AI image task that you initiate, you grant UpscaleLume a non-exclusive, royalty-free, time-limited license to process, temporarily store, transfer to necessary service providers, and deliver results to you, solely as necessary to complete that task. This license ends when the task is completed, the related files are deleted, or any legally required retention period expires.

You are fully responsible to UpscaleLume for, and will indemnify and hold UpscaleLume harmless from, all claims, actions, damages, liabilities, compensation, costs, and expenses (including reasonable attorneys’ fees, litigation costs, and legal expenses) arising from a third-party claim or threatened claim relating to intellectual-property infringement, infringement of third-party image or likeness rights, misappropriation of a third party’s trade secrets, infringement of any other third-party right, and/or unfair competition resulting from your use of the Services, where a competent court or tribunal issues a judgment or award, the matter is settled out of court, or a public authority imposes a penalty.

If we receive a valid notice from a competent authority, a complaint, dispute, rights claim, or penalty notice relating to User Content, or have a reasonable basis to believe that User Content infringes third-party rights, violates these Terms or applicable law, or presents a service-security concern, we may, within a reasonable scope, restrict the related task, remove temporary files, suspend an account, or take other necessary measures to prevent further harm. Please see the Privacy Policy and Part B of these Terms for the specific handling of images, personal data, and temporary files.

10. Fees, Billing, and Payment

Certain Services or features may require the purchase of paid credits. The name, price, currency, number of credits, validity period, and available payment methods for a credit package are those displayed on the pricing page and checkout page when you make a purchase. UpscaleLume currently offers one-time credit packages and does not offer automatic renewal, recurring billing, or monthly subscriptions. Unless we expressly state otherwise before purchase, completing a purchase does not create any subsequent automatic payment obligation.

By submitting an order, you authorize us or the payment service provider displayed at checkout to charge the amount due for that order using your selected payment method. Payment processing, payment authorization, taxes, currency conversion, additional charges, and billing information may also be subject to the terms of the payment service provider or card issuer. You must ensure that information provided for a purchase is true, complete, and valid.

After successful payment is confirmed by us or the payment service provider, the relevant credits will be added to the UpscaleLume account used for the purchase. Credits may be used only in that account and may not be redeemed for cash, sold, transferred, or moved between accounts. Credits expire at the end of the validity period displayed on the pricing page or checkout page. We may change credit packages, prices, or available payment methods in the future, but such changes will not alter the number of credits already purchased or a validity period that was expressly disclosed at the time of purchase.

Credit consumption for an AI task is governed by the rules displayed before the task is submitted. If your account has insufficient available credits, we may decline to create or continue the task. If a task cannot be completed because of a technical issue within our or a service provider’s control, we will return the credits deducted for that task under the applicable failed-task handling rules. A return of credits is not a cash refund.

11. Refunds

Refund requests are reviewed individually. If an UpscaleLume technical issue prevents you from using the Services normally and our support team cannot resolve it within a reasonable time, you may request a refund by emailing [email protected].

You must submit a refund request within fourteen (14) days after purchase. We may deny a refund for reasons including: (i) abuse of the refund process; (ii) a breach of these Terms; or (iii) substantial completion or use of the purchased Services.

An approved refund will be returned to the original payment method within ten (10) business days, subject to the payment service provider’s policies.

12. Intellectual Property

Except for the rights in User Content expressly retained by you under Section 9, all right, title, and interest in and to the Services, website, programs, interfaces, designs, text, graphics, logos, trademarks, domain names, databases, software, documentation, and other materials made available by UpscaleLume or its licensors belong to UpscaleLume or the applicable rights holder and are protected by applicable intellectual-property and other laws.

Other than the limited license expressly granted in these Terms, UpscaleLume grants you no ownership interest, intellectual-property license, or other right in the Services, programs, or related materials. Without our prior written permission, you may not copy, modify, distribute, publicly display, rent, sell, sublicense, remove proprietary notices from, or otherwise exploit those materials. You may not use the UpscaleLume name, logo, or trademarks in a way that suggests affiliation, sponsorship, or origin.

The Services may include technology, content, or services provided or licensed by third parties. Such third-party materials remain the property of their respective rights holders and may be subject to additional terms. Your rights in content submitted to AI Image Tools and in processing results are subject to Section 9 and the specific provisions in Part B of these Terms.

13. Feedback

If you voluntarily provide suggestions, comments, bug reports, reviews, or other feedback relating to the Services (collectively, “Feedback”), you retain rights in any pre-existing content contained in that Feedback. However, you grant UpscaleLume a worldwide, non-exclusive, royalty-free, transferable, sublicensable, perpetual, and irrevocable license to use, copy, modify, incorporate, and otherwise exploit that Feedback to operate, maintain, improve, or develop the Services, without compensation to you or any confidentiality obligation. “Feedback” does not include User Content submitted for processing or personal data contained in that User Content; those remain subject to Section 9 and the Privacy Policy. Do not submit confidential information through Feedback if you do not want it used in this way.

14. Service Availability, Updates, and Changes

UpscaleLume may modify or update programs that form part of the Services, including any component or feature, and may temporarily disable them where necessary to correct faults, optimize functionality or performance, and/or add functionality.

This website may be accessible from different countries or regions, but that does not mean that every Service or program is available in your location or that content generated through the Services is lawful, compliant, or permitted there. We or local authorities may restrict access to a particular Service, feature, or program in certain countries. You are responsible for ensuring that your use of the Services or programs is lawful where you use them. The Services are not available in every language.

16. Limitation of Liability

(a) UpscaleLume’s Liability

To the maximum extent permitted by mandatory applicable law, the Services are provided on an “as is” and “as available” basis, without any express, implied, or statutory warranty. In particular, UpscaleLume does not warrant or represent that the Services or processing results will be accurate, reliable, error-free, continuously available, or secure; that they will be compatible with your devices, software, or network environment; that they will resist unauthorized access; that they will be fit for a particular purpose or achieve a satisfactory result; that they will be uninterrupted; or that your use of the Services and processing results will comply with applicable law in every circumstance.

UpscaleLume makes the Services available over the internet on a 24/7 basis. However, UpscaleLume is not liable for, and disclaims liability in connection with, network connections that are unavailable or malfunctioning at any time for any reason.

UpscaleLume is also not liable for: (i) any direct or indirect loss of information not caused by UpscaleLume’s breach; (ii) any loss, including loss of profit, revenue, contracts, anticipated savings, data, goodwill, expenditure, or reputation; (iii) any alteration or loss of data; or (iv) indirect loss that neither you nor UpscaleLume could reasonably have foreseen when you began using the Services. Section 17 applies to delay or failure to perform caused by force majeure.

For free Services or features, UpscaleLume has no monetary liability arising from your use of them to the maximum extent permitted by applicable law. For paid Services, UpscaleLume’s aggregate liability arising from or relating to these Terms, the Services, or related matters will not exceed the amount you actually paid to UpscaleLume for the relevant Services during the twelve (12) months preceding the event giving rise to liability.

No oral or written information, communication, or advice creates or modifies a warranty or liability not expressly stated in this Section. You use the Services at your own risk; if you do not wish to assume that risk, you may stop using the Services.

(b) User Responsibility

You agree to indemnify and hold UpscaleLume harmless from all losses, liabilities, damages, and claims, including reasonable attorneys’ fees, legal-representation costs, and court costs, arising from: (i) your breach of any provision of these Terms; or (ii) your violation of any law or third-party right that adversely affects UpscaleLume.

In addition, if you breach these Terms, UpscaleLume may immediately take any other available action, including closing your account and/or suspending your access to the Services without prior notice, and you will not be entitled to damages solely as a result of that action.

This Section survives the termination of the contractual relationship between you and UpscaleLume.

17. Force Majeure

UpscaleLume is not liable for delays, interruptions, unavailability, or failures to perform caused by events beyond our reasonable control. Such events include natural disasters, fire, flood, earthquake, epidemic, war, terrorism, civil unrest, government action, changes in law or regulation, power outages, network or telecommunications failures, widespread failures of third-party infrastructure or service providers, cyberattacks, and similar events. We will use reasonable efforts to mitigate the effects of such events and restore the Services.

18. Changes to These Terms

We may revise these Terms from time to time in response to legal, regulatory, technical, service, or business developments. The latest version and its last-updated date will be posted on this page and will take effect when posted or on the effective date stated on the page. Please review this page periodically.

Continued use of the Services after a change takes effect constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Services before the change takes effect. Changes do not affect purchases, tasks, or rights and obligations that were completed or accrued before the effective date, unless applicable law requires otherwise.

19. Term, Suspension, and Termination

These Terms take effect when you first access or use the Services and remain in effect while you use them. You may stop using the Services at any time and may request account deletion through the method then provided through the Services. Stopping use or deleting an account does not affect accrued payment obligations, credit-use records, refund or dispute handling, data-retention obligations, or provisions that by their nature survive termination.

If we reasonably believe that you have breached these Terms, applicable law, or a third-party right; present a security, fraud, or abuse risk; have failed to pay due fees; or that continued provision of the Services may create an unreasonable risk or violate law, we may suspend, restrict, or terminate your access to any Service, account, order, or task at any time. Except as otherwise required by applicable law, Section 11, or the checkout page, suspension or termination for these reasons does not automatically create a right to a refund.

20. Notices and Electronic Communications

We may provide notices relating to the Services, your account, payment, security, or these Terms through service pages, in-account messages, the email address associated with your account, or another lawful method. You must keep account information accurate and current and review those notices promptly. Service notices are independent from marketing communications; opting out of marketing communications does not prevent us from sending necessary service notices.

21. Assignment

You may not assign, transfer, or delegate any right or obligation under these Terms without UpscaleLume’s prior written consent. UpscaleLume may assign its rights or obligations under these Terms to a successor in connection with a merger, acquisition, reorganization, asset sale, or another circumstance required by law, provided that the assignment does not diminish any mandatory rights available to you under applicable law.

22. Dispute Resolution

If a dispute arises between you and UpscaleLume concerning these Terms or the Services, both parties must first attempt in good faith to resolve it by emailing [email protected]. We will reasonably review and respond to the request as promptly as practicable after receiving it.

For a dispute arising from an AI technical issue attributable to UpscaleLume that prevents normal provision of the Services, we may, with priority under Sections 10 and 11, reprocess the task, return deducted credits, issue replacement credits of equivalent value, provide a refund, or offer another reasonable remedy. These measures do not constitute an admission of liability and do not affect any other remedy required by applicable law.

If you use the Services as a consumer, this Section does not exclude or limit any right, remedy, or jurisdictional rule that applicable law does not permit a contract to exclude or limit.

23. Miscellaneous

These Terms, the Privacy Policy incorporated by reference, the refund rules in Section 11, disclosures on pricing and checkout pages, and Specific Terms applicable to a particular Service constitute the entire agreement between you and UpscaleLume concerning the Services. Terms of a payment service provider or other third-party provider apply only to that provider’s own services.

If any provision of these Terms is held invalid, unlawful, or unenforceable, it will be limited to the minimum extent necessary or replaced with a valid provision, and the remaining provisions will remain in effect. UpscaleLume’s failure or delay in exercising a right is not a waiver of that right. Section headings are for convenience only and do not affect the interpretation of these Terms.

Part B — Specific Terms for Particular Services

This Part sets out specific terms for particular Services and forms part of Part A. Part A also applies to each Service. If the two Parts conflict, the specific terms in this Part that apply to the relevant Service will prevail. At present, this Part contains the specific terms for AI Image Tools. If we add other Services in the future, we may add their applicable specific terms to this Part. Processing of personal data is governed by the Privacy Policy.

I. AI Image Tools

24. AI Image Tool Terms

AI Image Tools are a set of artificial-intelligence image-processing features offered by UpscaleLume. They currently include AI image upscaling, AI background removal, and AI image enhancement. Specific features, available options, supported formats, and availability are those displayed on the relevant service page at the time of use.

To provide AI Image Tools, we operate the service components required for those features and may also use APIs or other means to integrate third-party artificial-intelligence service providers to perform AI tasks. To complete a task you initiate, we may need to provide necessary images and task information to those providers for processing. We take reasonable measures in selecting and managing service providers. A third-party service provider’s handling of its own service may also be subject to its applicable terms and privacy policy.

When you initiate an AI task, you agree that we may provide the input image and necessary task parameters to the AI service provider currently configured for the task, solely as necessary to complete it through automated processing. That processing may occur at facilities located outside your country or region and may involve an international transfer. For recipient categories, processing purposes, retention periods, and international-processing information, see the Privacy Policy. If you do not agree to this necessary processing, do not use the AI Image Tools.

Unless you separately provide express authorization, UpscaleLume will not itself use input or output images submitted to the AI Image Tools to train, fine-tune, or improve an artificial-intelligence model, and will not instruct a third-party AI service provider to use them for those purposes.

AI Image Tools are provided on an “as is” and “as available” basis. Machine-learning processing results may be inaccurate, incomplete, distorted, omitted, defective, or unsuitable for your intended use. You must independently review, verify, and confirm the suitability of each result before using, publishing, delivering, or relying on it. We may reasonably add, modify, suspend, or discontinue an AI Image Tool or feature.

25. Rules for Using AI Image Tools

In addition to the restrictions in Part A, you must not use AI Image Tools to:

  • generate, process, or distribute unlawful, defamatory, threatening, harassing, discriminatory, fraudulent, harmful, or otherwise inappropriate content;
  • process images or materials that infringe a third party’s intellectual-property, image or likeness, privacy, reputation, or other rights;
  • create, process, or distribute deepfakes, synthetic media, or manipulated content intended to deceive, defraud, or mislead another person;
  • create content involving child sexual exploitation or abuse, or content promoting violence, terrorism, hatred, or discrimination against an individual or group;
  • circumvent, disable, interfere with, or attempt to bypass safety measures, content restrictions, usage limits, verification processes, or technical safeguards of the AI Image Tools;
  • use AI Image Tools to develop, train, test, or optimize a competing artificial-intelligence or machine-learning system, model, or algorithm;
  • attempt to extract, copy, or reconstruct underlying models, algorithms, weights, training data, or related technology of the AI Image Tools; or
  • use AI Image Tools in a manner that violates applicable requirements relating to law, data protection, consumer protection, or artificial intelligence.

We may take reasonable technical and operational measures to maintain service security, identify unusual use, or enforce usage limitations. You must not attempt to bypass, disable, or interfere with those measures.

26. AI Image Tool Accounts

Account, sign-in, and credit requirements for AI Image Tools are those displayed on the relevant service page when you use the tool. Certain AI Image Tools or features may require a valid UpscaleLume account and sufficient paid credits; certain features may also be available through a trial, promotion, or other access arrangement under specified conditions. Section 7 of Part A applies to AI Image Tool accounts. You must also comply with current usage limitations applicable to the selected AI Image Tool, task options, and credit package.

27. AI Image Tool Credits and Task Charges

The name, price, currency, number of credits, validity period, and available payment methods for credit packages used with AI Image Tools are those displayed on the pricing page and checkout page. The general rules for one-time purchases, payment, credit validity, and refund eligibility are set out in Sections 10 and 11 of Part A.

The credits required for each AI task depend on the selected tool and options displayed on the page. If your account has insufficient available credits, we may decline to create or continue the task. If a task cannot be completed because of a technical issue within our or a service provider’s control, we will return the credits deducted for that task under the applicable failed-task handling rules. That return is not a cash refund. Payment, refunds, and dispute handling are also subject to Sections 10, 11, and 22, payment-provider rules disclosed at checkout, and applicable law.

28. AI Image Tool Content and Intellectual Property

You retain any rights you may have in content uploaded to AI Image Tools and in results generated from that content. UpscaleLume does not acquire ownership of your User Content by providing AI Image Tools. For clarity, the time-limited processing license granted under Section 9 also applies to AI tasks described in this Part.

You must ensure that you have all rights and authorizations necessary to submit images, select the requested processing, use processing results, and provide results to others. Laws in different jurisdictions may treat the protectability, registrability, or exclusive use of AI processing results differently. UpscaleLume makes no warranty that any result is protectable, non-infringing, commercially usable, or fit for a particular purpose.

29. Temporary Files in AI Image Tools

To complete an AI task, input images, intermediate files generated during processing, and output images are temporarily stored in our object storage or necessary service-provider systems. After a task is completed, the maximum download period for results and related temporary files is seventy-two (72) hours. After that period, the files are no longer available for download, and files temporarily retained in our systems for task delivery are deleted under the applicable cleanup mechanisms. We do not provide long-term storage, an image gallery, or permanent CDN distribution.

You are responsible for saving results during the download period. To the maximum extent permitted by applicable law, we are not liable if you cannot retrieve files because the download period expires, you do not download them in time, a network interruption occurs, a third-party provider fails, or you do not comply with these Terms. This does not affect rules applicable to a failed task for which we must return credits.

30. AI Image Tool Results and Limitation of Liability

To the maximum extent permitted by applicable law, UpscaleLume does not warrant that AI Image Tool results will be accurate, complete, reliable, error-free, unbiased, fit for a particular purpose, or meet your expectations. You are independently responsible for decisions to use, rely on, publish, commercialize, or otherwise act on processing results.

In particular, we are not liable for loss, damage, or claims arising from inaccurate, distorted, defective, or omitted results; your reliance on a result without independent verification; decisions or actions based on a result; a result’s unsuitability for its intended purpose; or your use of a result in a manner that infringes third-party rights. This Section does not exclude liability that applicable law does not permit us to exclude or limit.

31. Suspension and Termination of AI Image Tool Services

You may stop using AI Image Tools at any time. If we reasonably believe that you have breached these Terms, present a security risk, are suspected of unlawful or infringing conduct, attempt to circumvent usage restrictions, or that continued provision of the Services may create an unreasonable risk, we may suspend, restrict, or terminate your access to AI Image Tools or your account and may cancel tasks that have not started or cannot safely be completed.

Suspension or termination does not affect payment obligations, credit-use records, dispute handling, intellectual property, limitations of liability, indemnification obligations, or provisions that by their nature survive termination. Refund eligibility for unused paid credits is governed by Section 11 and applicable law.
