UpscaleLume (“we,” “us,” or “our”) values and is committed to protecting your privacy. This Privacy Policy explains the information we collect when you use UpscaleLume, how we use and protect that information, and the choices available to you regarding personal information.

UpscaleLume is an online image-processing platform that offers image upscaling, background removal, image enhancement, and other image-processing tools to help users improve the clarity, quality, or presentation of uploaded images.

This Policy applies to information that we process when you access or use these Services. It does not govern services independently provided by third parties. When you use such services, please review their applicable terms and privacy policies.

We collect the following categories of information depending on how you use the Services:

• Account and sign-in information: such as your email address, display name, and information needed to create, verify, protect, and manage your account. If you choose third-party sign-in, we may receive basic account information made available by that provider within the scope of your authorization.
• Order and payment information: such as orders, purchased credits, amounts, currency, payment status, and information needed to process refunds, disputes, or fraud prevention. Payment-card information is processed directly by the payment service provider displayed at checkout; we do not store your full payment-card information.
• Uploaded images and task information: images you submit for processing, selected features, necessary processing parameters, task status, and result files. We process this information only as necessary to provide the image-processing and download services you request.
• Device and usage information: such as IP address, browser or device type, service-usage records, and necessary security logs, used to operate the Services, protect accounts, prevent abuse, and troubleshoot issues.
• Communications: information contained in support requests, refund requests, error reports, reviews, or other communications that you choose to send us.

We use the information described above only as necessary to provide, maintain, and protect the Services, including to:

• create and manage accounts, verify email addresses, maintain sessions, respond to requests, and provide support;
• create, perform, deliver, and troubleshoot AI image tasks that you initiate;
• process orders, issue and deduct credits, process refunds, and meet accounting, tax, and other legal obligations;
• prevent fraud, abuse, unauthorized access, unlawful use, and other security incidents, and enforce the Terms of Service;
• maintain, test, troubleshoot, and improve the security, reliability, and performance of the website and Services; and
• process information where required by applicable law, with your separate consent, or where necessary to protect the rights and safety of UpscaleLume, users, or third parties.

Free image compression, conversion, resizing, and editing tools process images locally in your browser. Those images are not uploaded to UpscaleLume or an AI service provider.

When you voluntarily use an AI Image Tool, input images, intermediate files, and output images may be processed temporarily through private object storage or the systems of necessary technical service providers in order to complete your request. After a task is completed, the maximum download period for results and related temporary files is seventy-two (72) hours. After that period, the files are no longer available for download, and files temporarily retained in our systems for task delivery are deleted under the applicable cleanup mechanisms.

We do not provide long-term image storage, public file links, a permanent gallery, or permanent CDN distribution. Downloads are provided through time-limited links. Please save any result you need during the download period.

Certain functions of the Services rely on trusted third-party service providers, such as Cloudflare, for cloud infrastructure, payment processing, security verification, identity authentication, and email services.

These providers process information only to the extent necessary to provide their respective services and are expected to protect that information under applicable agreements and privacy rules.

We do not sell your personal information or your images to third parties. We may disclose relevant information where required by applicable law or where necessary to respond to valid legal process, enforce our Terms, or protect the rights, property, or safety of users, the public, UpscaleLume, or third parties.

If a merger, acquisition, reorganization, financing, asset sale, or similar transaction occurs, we may disclose necessary information to the relevant transaction parties to the extent permitted by law and require them to process that information in accordance with applicable law.

Unless you separately provide express authorization, UpscaleLume will not use input or output images submitted to AI Image Tools to train, fine-tune, or improve artificial-intelligence models, and will not instruct a third-party technical service provider to use them for those purposes.

Third-party technical service providers may process necessary technical information or logs under their applicable terms for operations and maintenance, security and anti-abuse measures, troubleshooting, content safety, or compliance with legal obligations. We use those providers only to the extent necessary to provide the Services. Their independent processing activities are governed by their terms and privacy policies.

Our service providers and their processing facilities may be located outside your country or region. Accordingly, when you initiate an AI task or use account, payment, or security-verification functions, related information may be transferred internationally and processed where the provider operates. Image-processing routes may vary according to the feature used, task routing, object-storage configuration, and service providers configured at the time. If you do not wish to allow an international transfer necessary for AI processing, do not initiate an AI task. You may still use free image tools that are processed locally in your browser as described on the relevant page.

We may use cookies and other browser technologies to:

• maintain sign-in status, account security, and other essential Service functions;
• save preferences such as language settings; and
• prevent abuse and protect website security.

Disabling or restricting cookies or browser technologies that are necessary for operation of the Services may prevent accounts, sign-in, security verification, or other functions from working properly. You may adjust relevant choices through your browser settings.

When you use third-party sign-in, checkout, or security-verification functions, the relevant third party may also use cookies or other browser technologies on your device under its own policies. Its handling is governed by its privacy policy.

We use commercially reasonable administrative, technical, and organizational safeguards designed to protect user information.

• HTTPS encryption for communications;
• restricted internal access to production systems;
• secure cloud infrastructure;
• temporary image storage;
• automatic cleanup of task files temporarily stored in our systems; and
• ongoing monitoring for abuse and unauthorized access.

Although we take reasonable measures to protect user information, no method of transmission over the internet or method of storage can be guaranteed to be completely secure.

If you have a question about this Policy, our processing of personal information, or deleting your account, you may email [email protected]. To protect account and information security, we may require reasonable identity verification and will handle relevant requests to the extent required by applicable law. Records relating to payment, refunds, financial or tax matters, and information necessary for fraud prevention, security, dispute handling, or legal compliance may not be deleted immediately.

The Services are not directed to persons under eighteen (18) years of age. If you believe that a minor has provided us with personal information, please contact us as described in Section 9 so that we can take appropriate measures to the extent required by applicable law.

We may update this Policy from time to time in response to legal, regulatory, technical, service, or business developments. The current version and its last-updated date will be posted on this page and will take effect when posted or on the effective date stated on the page. Please review this page periodically.
